เช็ค คืออะไร

ตามประมาลกฏหมายแพ่งและพาณิชย์ บรรพ 3 เอกเทศสัญญา ลักษณะ 21 หมวด 4 เช็ค มาตร 987 ได้ให้คำจำกัดความของเช็คไว้ว่า
“ อันว่าเช็คนั้น คือหนังสือตราสารซึ่งบุคคลคนหนึ่งเรียกว่าผู้สั่งจ่าย สั่งธนาคารให้ใช้เงินจำนวนหนึ่งเมื่อทวงถามให้แก่บุคคลอีกคนหนึ่ง หรือให้ใช้ตามคำสั่งของบุคคลอีกคนหนึ่ง อันเรียกว่าผู้รับเงิน “

เช็คบ้านเรา มีกฎหมายควบคุมอยู่ 2 ฉบับ คือ

1. ประมวลกฎหมายแพ่งและพาณิชย์ บรรพ 3 เอกเทศสัญญา ลักษณะ 21 ว่าด้วยเรื่องตั๋วเงิน หมวด 4 เช็ค
2. พระราชบัญญัติว่าด้วยความผิดอันเกิดจาการใช้เช็ค พ.ศ. 2534
ประมวลกฎหมายแพ่งและพาณิชย์ จะควบคุมในเรื่องเงื่อนไขและวิธีการออกเช็คให้ถูกต้องตามกฎหมาย เรื่องความสมบูรณ์ของเช็ค เรียกว่าเป็นเรื่องทางแพ่ง
พระราชบัญญัติความผิดอันเกิดจาการใช้เช็ค พ.ศ. 2534 จะควบคุมให้มีการออกเช็คกันโดยสุจริต ถ้ามีการออกเช็คโดยทุจริตก็จะต้องรับโทษทางอาญาและได้กำหนดโทษไว้ชัดเจนด้วย
การใช้เช็ค
พอจะทราบแล้วนะครับว่าเช็คคืออะไร การใช้เช็คก็มีกฎหมายคอยควบคุมอยู่ คงเพิ่มความมั่นใจในการที่จะใช้เช็คกันแล้วนะครับ ทีนี้เรามาเริ่มวิธีใช้เช็คกันเลยครับ
ผู้ที่ประสงค์จะมีเช็คไว้ใช้ในการสั่งให้ธนาคารจ่ายเงิน ( ถอนเงิน ) ไม่ใช่อยู่ดี ๆ จะขอใช้เช็คได้เลยนะครับ ผู้ที่ประสงค์จะใช้เช็คต้องไปเปิดบัญชีเงินฝากกระแสรายวันกับธนาคารไว้ก่อนนะครับ จึงจะใช้เช็คได้
ธนาคารต่าง ๆ จะพิถีพิถันในการับเปิดบัญชีเงินฝากกระแสรายวันกับลูกค้าประเภทนี้มากกว่าประเภทอื่น โดยอาจมีการพิจารณาถึงประวัติของลูกค้าโดยเฉพาะประวัติการใช้เช็คของธนาคารอื่น ๆ ด้วย
รายละเอียดในการเปิดบัญชีกระแสรายวันว่าเขาทำกันอย่างไรจะไม่กล่าวไว้ในที่นี้นะครับ ให้สอบถามกับสำนักธนาคารที่เราประสงค์จะเปิดบัญชีนะครับ ในที่นี้จะว่าด้วยเรื่องการใช้เช็คล้วน ๆ ครับ
เมื่อเราเปิดบัญชีไว้กับธนาคารสำนักงานใด การจะเขียนเช็คสั่งจ่ายเงินออกจากบัญชีของตนก็ต้องใช้แบบฟอร์มเช็คที่ธนาคารสำนักงานนั้นมอบให้นะครับ ห้ามใช้เช็คแบบฟอร์มอื่นโดยไม่ได้ตกลงกับธนาคารเสียก่อนนะครับ ธนาคารจะคืนเช็คของท่านทันที


เช็คที่ธนาคารต่าง ๆ ในบ้านเราจัดพิมพ์ มีอยู่ 2 แบบ คือ


เช็คจ่ายผู้ถือ [BEARER CHEQUE]
เช็คจ่ายตามคำสั่ง [ORDER CHEQUE]
เช็คจ่ายผู้ถือ
เช็คจ่ายผู้ถือ หรือที่นิยมเรียกกันว่า “เช็คผู้ถือ” คือเช็คที่ทางธนาคารต่าง ๆ ออกแบบไว้เพื่อจุดประสงค์ให้ผู้สั่งจ่ายเช็คโดยระบุชื่อผู้รับเงินหรือจะไม่ระบุชื่อผู้รับเงินก็ได้
ธนาคารในบ้านเราได้ออกแบบเช็คจ่ายผู้ถือ โดยมีสาระสำคัญอยู่ที่ช่องว่างที่ให้ผู้สั่งจ่ายเช็คกรอกเพื่อระบุผู้รับเงินดังนี้ “จ่าย…………………………………………………….หรือผู้ถือ[or bearer]"
เช็คแบบนี้ผู้สั่งจ่ายจะสั่งจ่ายโดยไม่กรอกอะไรลงในช่องว่าง “จ่าย…………………..หรือผู้ถือ “ เพียงแต่กรอก จำนวนเงินทั้งตัวเลขและตัวหนังสือแล้วลงลายมือชื่อผู้สั่งจ่าย ก็ถือว่าเช็คสมบูรณ์แล้วครับ




หรือกรอกคำว่า “เงินสด” ลงในช่องว่าง “จ่าย………………………หรือผู้ถือ” ก็มีผลเช่นเดียวกันครับ




แม้จะกรอกซื่อ นามสกุล ผู้รับเงินลงไปในช่องว่าง “จ่าย……………………หรือผู้ถือ” โดยไม่ได้ขีดฆ่าคำว่า “หรือผู้ถือ” ออก ก็ยังเป็นเช็คผู้ถืออยู่ กรณีนี้หมายความว่า จ่ายให้กับผู้ที่ถูกระบุชื่อไว้ในเช็ค หรือ ผู้ถือก็ได้




การสั่งจ่าย “เช็คจ่ายผู้ถือ” โดยไม่ได้ระบุชื่อผู้รับเงินในช่องว่าง “ จ่าย…………………………หรือผู้ถือ “ และยังขีดฆ่าคำว่า ”หรือผู้ถือ “ ออก เช็คฉบับนี้จะกลายเป็นเช็ค “จ่ายตามคำสั่ง ” ทันที ถ้านำไปขึ้นเงินก็จะถูกปฏิเสธจากธนาคาร เพราะเป็นเช็คที่ไม่สมบูรณ์ตามกฎหมาย(ไม่มีชื่อผู้รับเงิน)




หรือเขียนคำว่า “เงินสด” ลงในช่องว่าง “ จ่าย……………………..หรือผู้ถือ “ แล้วขีดฆ่าคำว่า “ หรือผู้ถือ “ ออก เช็คฉบับนี้ก็กลายเป็นเช็ค “ จ่ายตามคำสั่ง “ เช่นกัน แต่เป็นเช็คที่ไม่สมบูรณ์ตามกฏหมาย เพราะว่า คำว่า “เงินสด” ไม่ใช่ชื่อผู้รับเงิน

การจ่ายเงินของธนาคาร
ธนาคารจะจ่ายเงินสดให้แก่ใครก็ได้ที่เป็นผู้ถือ “เช็คจ่ายผู้ถือ “ มาขอขึ้นเงิน

การโอนเปลี่ยนมือ
เช็คจ่ายผู้ถือ สามารถโอนเปลี่ยนมือกันได้เพียงโดยการส่งมอบเช็คให้แก่กันก็เป็นอันใช้ได้ ดังนั้นใครก็ได้ที่เป็นผู้ถือเช็คแบบนี้ไปขึ้นเงินกับธนาคาร ธนาคารก็จะจ่ายเงินสดให้ทันทันที อันนี้มีกฎหมายรับรองนะครับ ตาม ป.พ.พ.มาตรา 989 วรรคแรกประกอบกับมาตรา 918 ครับ
ป.พ.พ.มาตรา 989 วรรคแรกมีใจความว่า ”ให้ยกบทบัญญัติในหมวด 2 ว่าด้วยตั๋วแลกเงินมาบังคับในเรื่องเช็คเพียงเท่าที่ไม่ขัดกับสภาพแห่งตราสารชนิดนี้ คือมาตรา 910 , 914 ถึง 923……”
ป.พ.พ.มาตรา 918 มีใจความว่า “ ตั๋วแลกเงินอันสั่งให้ใช้เงินแก่ผู้ถือนั้น ท่านว่าย่อมโอนไปเพียงด้วยส่งมอบให้กัน “
การใช้เช็คแบบนี้จึงมีความเสี่ยงสูง ถ้าเกิดท่านทำเช็คสูญหายหรือเช็คถูกลักถูกขโมยก็จะป้องกันได้ยากมาก จึงควรใช้เช็คแบบนี้ได้เฉพาะในกรณี เมื่อไปเขียนเบิกเงินสดที่ธนาคารเอง หรือเมื่อสั่งจ่ายเงินไม่มากนัก

การใช้เช็คผู้ถือให้ปลอดภัยต้องทำอย่างไร
ถ้าจำเป็นจริง ๆ ก็มีวิธีเดียวครับ คือให้ระบุชื่อ นามสกุลผู้รับเงินลงไปในช่องว่าง “จ่าย………………………..หรือผู้ถือ “ แล้วให้ขีดฆ่าคำว่า “หรือผู้ถือ” ออก ก็จะปลอดภัยครับ แต่การขีดฆ่าคำว่า “หรือผู้ถือ” ออก เช็คฉบับนั้นก็จะกลายเป็น”เช็คจ่ายตามคำสั่ง”ทันที การนำเช็คไปขึ้นเงินกับธนาคาร หรือเมื่อต้องการโอนเปลี่ยนมือก็ต้องปฏิบัติตามเงื่อนไขของ”เช็คจ่ายตามคำสั่ง” ซึ่งจะได้กล่าวต่อไป




เช็คจ่ายตามคำสั่ง

เช็คจ่ายตามคำสั่ง หมายถึง เช็คที่ต้องระบุชื่อผู้รับเงินไว้ในเช็คให้ถูกต้องครบถ้วน การนำเช็คจ่ายตามคำสั่งที่ยังไม่ระบุชื่อผู้รับเงินไปขอขึ้นเงินกับธนาคาร จะถูกปฏิเสธการจ่ายเงินจากธนาคารทันที เพราะเป็นเช็คที่มีรายการไม่สมบูรณ์ครบถ้วนตามกฏหมาย ข้อนี้ก็มีกฎหมายรับรองไว้ ตาม ป.พ.พ. มาตรา 988 ซึ่งมีใจความอยู่ว่า
“อันเช็คนั้น ต้องมีรายการดังกล่าวต่อไปนี้ คือ
(๑) คำบอกชื่อว่าเป็นเช็ค
(๒) คำสั่งอันปราศจากเงื่อนไขให้ใช้เงินเป็นจำนวนแน่นอน
(๓) ชื่อ หรือยี่ห้อสำและนักของธนาคาร
(๔) ชื่อ หรือยี่ห้อของผู้รับเงิน หรือคำจดแจ้งให้ใช้เงินแก่ผู้ถือ
(๕) สถานที่ใช้เงิน
(๖) วันและสถานที่ออกเช็ค
(๗) ลายมือชื่อผู้สั่งจ่าย “
ธนาคารต่าง ๆ ในเมืองไทย ได้ออกแบบเช็คจ่ายตามคำสั่ง โดยมีสาระสำคัญอยู่ที่ช่องว่างที่ให้ระบุชื่อผู้รับเงินดังนี้ “ จ่าย……………………………………………………หรือตามคำสั่ง[or order] “




ดังนั้นเวลาจะเขียนเช็คสั่งจ่ายเงินให้ใคร ต้องเขียนซื่อ นามสกุล ของผู้รับเงิน ลงในช่องว่าง “จ่าย……………………………..หรือตามคำสั่ง “ ให้ครบถ้วนสมบูรณ์ มิฉะนั้นเมื่อนำเช็คไปขอขึ้นเงินจะถูกปฏิเสธการจ่ายเงินจากธนาคาร





สั่งจ่ายเช็คโดยไม่ได้ระบุชื่อผู้รับเงินลงในช่องว่าง “ จ่าย……………………………หรือตามคำสั่ง “ โดยปล่อยว่างไว้เฉย ๆ อย่างนี้เป็นเช็คที่ไม่สมบูรณ์ตามกฎหมาย ธนาคารจะปฏิเสธการจ่ายเงิน
เขียนชื่อ นามสกุล ผู้รับเงิน ในช่องว่าง “ จ่าย…………………………หรือตามคำสั่ง” แล้วขีดฆ่าคำว่า “หรือตามคำสั่ง “ ออก เพื่อให้เป็นเช็คผู้ถือไม่ได้นะครับ เช็คฉบับนี้ยังคงเป็น “เช็คจ่ายตามคำสั่ง “อยู่ครับ การส่งมอบหรือการเปลี่ยนมือต้องทำตามเงื่อนไขของ “ เช็คจ่ายตามคำสั่ง “



สั่งจ่ายเช็คโดยระบุคำว่า “ เงินสด “ ลงในช่องว่าง “ จ่าย…………………………..หรือตามคำสั่ง “ ของเช็คจ่ายตามคำสั่ง ถือว่าเป็นเช็คที่ไม่สมบูรณ์ตามกฎหมาย เพราะคำว่า “เงินสด” ไม่ใช่ชื่อผู้รับเงิน
สั่งจ่ายเช็คโดยระบุคำว่า “ เงินสด “ ลงในช่องว่าง “ จ่าย…………………………..หรือตามคำสั่ง “ ของเช็คจ่ายตามคำสั่ง แล้วขีดฆ่าคำว่า “ หรือตามคำสั่ง “ ออก ยังคงถือว่าเป็น “เช็คจ่ายตามคำสั่ง “ อยู่ แต่เป็นเช็คที่ไม่สมบูรณ์ตามกฏหมาย ที่ไม่สมบูรณ์ตามกฎหมาย เพราะคำว่า “เงินสด” ไม่ใช่ชื่อผู้รับเงิน

การโอนเปลี่ยนมือเช็คจ่ายตามคำสั่ง
การโอนเปลี่ยนมือเช็คจ่ายตามคำสั่ง ทำได้ด้วยการที่ผู้ทรงเช็คสลักหลังแล้วส่งมอบ ซึ่งมีกฎหมายรับรองไว้เหมือนกัน คือ ป.พ.พ. มาตรา 989 ประกอบมาตรา 917 ครับ
มาตรา 989 มีใจความว่า ให้ยกบทบัญญัติในหมวด 2 ว่าด้วยตั๋วแลกเงินมาใช้บังคับในเรื่องเช็ค
มาตรา 917 วรรคหนึ่ง ว่าด้วยเรื่องการโอนตั๋วเงินที่นำมาใช้บังคับในเรื่องเช็คได้ มีใจความว่า “ อันตั๋วแลกเงินทุกฉบับ ถึงแม้ว่าจะมิใช่สั่งจ่ายให้แก่บุคคลเพื่อเขาสั่งก็ตาม ท่านว่าย่อมโอนให้กันได้ด้วยการสลักหลังและส่งมอบ “
การสลักหลัง หมายถึง การเขียนข้อความพร้อมกับการลงลายมือชื่อหรือลงลายมือชื่ออย่างเดียวที่ด้านหลังของเช็คเพื่อแสดงถึงการโอนเช็คนั้น

การสลักหลัง มี 2 แบบ คือ
1. สลักหลังเฉพาะ หมายถึง การสลักหลังเช็คโดยระบุชื่อผู้รับโอนไว้ด้วย พร้อมด้วยลงลายมือชื่อผู้สลักหลัง เช่น นายดำต้องการโอนเช็คให้นายเขียว นายดำจึงสลักหลังว่า โอนให้นายเขียว และลงลายชื่อนายดำ แล้วส่งมอบเช็คนั้นให้นายแดง ก็เป็นอันว่าสมบูรณ์ตามกฎหมายแล้วครับ




2. สลักหลังลอย หมายถึง การสลักหลังโดยลงลายมือชื่อผู้สลักเพียงอย่างเดียว ไม่ได้ระบุชื่อผู้รับโอนไว้ด้วย เช่น ถ้านายดำต้องการโอนเช็คให้นายเขียว นายดำเพียงลงลายมือชื่อที่ด้านหลังเช็คแล้วส่งมอบให้นายเขียวก็เป็นอันสมบูรณ์เช่นกัน




การสลักหลัง ถ้าประสงค์จะโอนเช็คให้เฉพาะตัว ก็สามารถระบุการห้ามสลักหลังต่อไว้ก็ได้ เช่น นายดำต้องการโอนเช็คให้นายเขียวเฉพาะตัว นายดำ ต้องสลักหลังว่า “ โอนให้นายเขียว “ แล้วระบุข้อความในบรรทัดต่อมาว่า “ ห้ามสลักหลังต่อ “ และลงลายมือชื่อนายดำไว้ แล้วส่งมอบให้นายเขียว อย่างนี้ นายเขียว ไม่สามารถสลักหลังโอนให้ใครอีกต่อไป ถ้านายเขียวขืนโอนต่อ นายดำก็พ้นความรับผิดต่อเช็คนั้นกับบุคคลผู้รับโอนต่อจากนายเขียว

การสลักหลังต้องเป็นข้อความอันปราศจากเงื่อนไขได ๆ ถ้ามีไว้ให้ถือว่าเงื่อนไขนั้นมิได้เขียนไว้เลย เช่น นายเขียวต้องการโอนเช็คให้นายเหลือง นายเชียวเขียนสลักหลังว่า “ โอนให้นายเหลือง” แล้วบรรทัดต่อมา เขียนว่า

“ การสลักหลังนี้จะมีผลสมบูรณ์ก็ต่อเมื่อนายเหลืองมีลูกเป็นผู้ชาย” เช่นนี้ถือว่าเงื่อนไขนี้ไม่ได้เขียนไว้เลย

การสลักหลังเช็คเพื่อโอนเป็นบางส่วนเป็นโมฆะตามกฎหมาย เช่น นายเหลืองได้รับโอนเช็คจำนวน 100,000 บาท แล้วนายเหลือง ต้องการโอนเช็คฉบับนี้ให้นายม่วง แต่นายเหลืองสลักหลังว่า “ โอนให้นายม่วง 50,000 บาท และลงชื่อนายขาวแล้วส่งมอบให้นายเหลือง เช่นนี้ นายม่วงไม่สามารถนำเช็คฉบับนี้ไปเรียกรับเงินตามเช็คไม่ได้แม้แต่บาทเดียว เพราะถือว่าเช็คฉบับนี้เป็นโมฆะตามกฎหมาย หากนายเขียวต้องการโอนเช็คฉบับนี้ต่อให้นายเหลือง นายเขียวก็สลักหลังต่อจากนายดำ ตามตัวอย่างได้เลย




หมายเหตุ การสลักหลังควรลงวันที่สลักหลังไว้ด้วย เพื่อความสะดวกในการตรวจสอบว่าใครสลักหลังก่อนหลังและมีการสลักหลังติดต่อกันโดยไม่ขาดสาย เมื่อเกิดปัญหาถกเถียงกันจะสามรถทราบได้ว่าใครเป็นผู้ทรงเช็คโดยชอบ

เช็คขีดคร่อมและเช็คไม่ขีดคร่อมมีความหมายว่าอย่างไร
เช็คขีดคร่อม หมายถึง เช็ค ที่เขียนเส้นขนานคู่ขีดขวางไว้ด้านหน้าเช็ค เป็นการแสดงให้ธนาคารรับฝากเข้าบัญชีของผู้ทรงเช็คเท่านั้น ผู้ทรงเช็คหมดสิทธิ์ที่จะขอเบิกเงินสดจากธนาคาร
ผู้ทรงเช็คขีดคร่อมจึงไม่สามารถนำเช็คมาขอเบิกเงินสดตามเช็คนั้นได้ในทันที จะต้องนำฝากเข้าบัญชีเงินฝากของตนที่ได้เปิดไว้กับธนาคารแล้วให้ธนาคารผู้รับฝากเป็นผู้ไปเรียกเก็บเงินให้เท่านั้น
เช็คไม่ขีดคร่อม หมายถึง เช็ค ที่ผู้ทรงเช็คสมารถนำมาขอเบิกเงินสดตามเช็คจากธนาคารได้เลย
คิดว่าพอจะทราบความหมายกันแล้วนะครับ เช็คทั้ง 2 ชนิดนี้ นิยมใช้พอ ๆ กัน แต่ถ้าในทางธุรกิจแล้วจะนิยมใช้เช็คขีดคร่อมกันมากกว่า
เช็คไม่ขีดคร่อม ไม่มีรายละเอียดที่ซับซ้อนมากนัก การใช้เช็คชนิดนี้ให้พิจารณาให้ถูกต้องตามเงื่อนไขของกฎหมายเรื่องเช็คทั่ว ๆ ไปก็ถือว่าใช้ได้แล้ว ก็จะขอข้ามไป โดยไม่ขอกล่าวในที่นี้ ส่วนการใช้เช็คขีดคร่อมนั้น นอกจากจะต้องทำให้ถูกต้องตามเงื่อนไขของกฎหมายเรื่องเช็คทั่ว ๆ ไปแล้วยังจะต้องพิจารณาถึงลักษณะพิเศษของเช็คชนิดนี้ให้ดี ๆ ด้วย

ประเภทของเช็คขีดคร่อม
เช็คขีดคร่อมมี 2 ประเภท คือ

1. เช็คขีดคร่อมทั่วไป หมายถึง เช็คขีดคร่อมที่สามารถนำฝากเข้าบัญชีของธนาคารใดก็ได้ ตัวอย่างการขีดคร่อมทั่วไป เช่น ขีดเส้นขนานตัดในแนวเฉียงบริเวณมุมบนซ้ายของเช็คแล้วเขียนข้อความไว้ด้านในระหว่างเส้นสองเส้นนั้น เช่น เขียนคำว่า
“& co “ หมายความว่า ต้องนำฝากเข้าบัญชีตามชื่อที่ระบุไว้ด้านหน้าเช็คเท่านั้น ถ้าจะนำฝากเข้าบัญชีคนอื่น ต้องมีการลงลายมือชื่อสลักหลังของผู้สลักหลังคนแรก และหรือคนอื่น ๆ ต่อ ๆ กันมา จนถึงลายมือชื่อสลักหลังของผู้ทรงคนสุดท้ายซึ่งสลักหลังโอนให้กับผู้นำฝากเข้าบัญชีธนาคาร





“ ห้ามเปลี่ยนมือ “ หรือ “ Not Negotiable “ หมายความว่า เช็คฉบับนี้ไม่อาจโอนต่อไปได้ด้วยการสลักหลัง การนำฝากเข้าบัญชีธนาคารต้องนำฝากเข้าบัญชีของผู้มีชื่อระบุไว้ที่ด้านหน้าเช็คเท่านั้น (การขีดคร่อมแบบนี้ห้ามนำไปใช้กับเช็คจ่ายผู้ถือที่ไม่ระบุชื่อผู้รับเงินหรือเช็คจ่ายผู้ถือทีเขียนคำว่า “ เงินสด” ไว้ที่ช่องว่าง “ จ่าย………………หรือผู้ถือ ” ถ้าขีดคร่อมเช็ค "จ่ายผู้ถือ"แบบนี้แล้วนำเช็คไปฝากเข้าบัญชีธนาคาร ธนาคารจะปฏิเสธการรับฝากทันที เพราะไม่มีชื่อตามบัญชีที่ด้านหน้าเช็ค หรือกรณีเขียนระบุ “เงินสด” ธนาคารจะปฏิเสธการรับฝากเช่นกัน เพราะคำว่า “เงินสด”ไม่ใช่ชื่อคน ธนาคารไม่อาจรู้ได้ว่าห้ามใคร และยังทำให้เช็คฉบับนี้เสียไปเลย เพราะจำนำไปเบิกเงินสดอย่างเช็คจ่ายผู้ถืออีกไม่ได้ )

ถ้าขีดเส้นสองเส้นในแนวขนานไว้เฉย ๆ โดยไม่เขียนอะไร หมายความว่า เช็คฉบับนี้จะนำมาขอเบิกเงินสดไม่ได้ ต้องนำฝากเข้าบัญชีธนาคารเท่านั้น ไม่ว่าจะเป็นเช็ค “ จ่ายผู้ถือ “ หรือเช็ค “ จ่ายตามคำสั่ง “






2. เช็คขีดคร่อมเฉพาะ หมายถึง เช็คขีดคร่อมที่ระบุชื่อธนาคารไว้ด้วย การนำเช็คขีดคร่อมแบบนี้ฝากเข้าบัญชีธนาคาร จะต้องนำฝากเข้าบัญชีธนาคารที่ระบุชื่อขีดคร่อมไว้เท่านั้น
ตัวอย่างการขีดคร่อมเฉพาะ เช่น ขีดเส้นขนานตัดในแนวเฉียงบริเวณมุมบนซ้ายของเช็คแล้วเขียนชื่อธนาคารไว้ด้านในระหว่างเส้นสองเส้นนั้น เช่น เขียนคำว่า
"ธนาคารกรุงสยาม " หมายความว่า เช็คฉบับนี้จะนำฝากเข้าบัญชีธนาคารอื่นไม่ได้ ต้องนำฝากเข้าบัญชีของธนาคารกรุงสยามเท่านั้น สมารถใช้ได้กับเช็ค “ จ่ายผู้ถือ “ และเช็ค “จ่ายตามคำสั่ง “





เช็คที่ขีดคร่อม และเขียนข้อความ “ห้ามเปลี่ยนมือ “ และยังมีขีดคร่อมว่า “ธนาธารกรุงสยาม“ ไว้ด้วย หมายความว่า โอนเปลี่ยนมือให้คนอื่นไม่ได้ และต้องนำฝากเข้าบัญชีของธนาคาร กรุงสยาม เท่านั้น






การออกเช็คที่เป็นความผิดทางอาญา
การออกเช็คโดยไม่ระมัดระวัง ในบางครั้งอาจมีความผิดในทางอาญาได้ เรื่องนี้ได้บัญญัติไว้ชัด ในพระราชบัญญัติว่าด้วยความผิดอันเกิดจากการใช้เช็ค พ.ศ. 2534 มาตรา 4 ซึ่งบัญญัติไว้ดังนี้
“ มาตรา 4 ผู้ใดออกเช็คเพื่อชำระหนี้ที่มีอยู่จริงและบังคับได้ตามกฎหมาย โดยมีลักษณะหรือมีการกระทำอย่างใดอย่างหนึ่งดังต่อไปนี้
(๑) เจตนาที่จะไม่ให้มีการใช้เงินตามเช็คนั้น
(๒) ในขณะที่ออกเช็คนั้นไม่มีเงินอยู่ในบัญชีอันจะพึงให้ใช้เงินได้
(๓) ให้ใช้เงินมีจำนวนสูงกว่าจำนวนเงินที่มีอยู่ในบัญชี อันจะพึงให้ใช้เงินได้ในขณะที่ออกเช็คนั้น
(๔) ถอนเงินทั้งหมดหรือแต่บางส่วนออกจากบัญชีอันพึงให้ใช้เงินตามเช็คจนจำนวนเงินเหลือไม่เพียงพอที่จะใช้เงินตามเช็คนั้นได้
(๕) ห้ามธนาคารมิให้ใช้เงินนั้นโดยเจตนาทุจริต
เมื่อได้มีการยื่นเช็คเพื่อให้ใช้เงินโดยชอบด้วยกฎหมาย ถ้าธนาคารปฏิเสธไม่ใช้เงินตามเช็คนั้น ผู้ออกเช็คมีความผิดต้องระวางโทษปรับไม่เกินหกหมื่นบาท หรือจำคุกไม่เกินหนึ่งปี หรือทั้งปรับทั้งจำ “
ที่ยกข้อกฎหมายมานี้ก็เพื่อให้ทราบถึงองค์ประกอบของกฎหมายที่ทำให้การออกเช็คแล้วเป็นความผิดและมีโทษในทางอาญา เพื่อจะได้ใช้ความระมัดระวังในการออกเช็คให้มากขึ้น จะได้ไม่ต้องมีคดีขึ้นโรงขึ้นศาลให้เสียเวลาทำมาหากิน
